FARM FESTIVAL LIABILITY WAIVER AND RELEASE OF CLAIMS

1. Assumption of Risk
I understand that participation in the Green Acres Corn Maze and Pumpkin Patch at Gibson’s Green Acres may involve certain risks, including but not limited to uneven terrain, farm animals, farm equipment, exposure to allergens, inclement weather, and other hazards associated with an agricultural environment and agritourism activities. I voluntarily assume all risks, known and unknown, associated with participation in this Event.
2. Waiver and Release of Liability
In consideration for being allowed to participate in the Event, I hereby waive, release, and discharge Gibson’s Green Acres, its owners, employees, volunteers, agents, affiliates, successors, and assigns (collectively, the “Released Parties”) from any and all claims, liabilities, actions, damages, or losses arising out of or in connection with my participation in the Event, whether caused by negligence, the condition of the premises, or otherwise.
This waiver extends to personal injury (including death), property damage, and any other loss or harm that may occur while on the premises of the farm or participating in any Event activity.
3. Medical Treatment
I authorize the Released Parties to obtain emergency medical treatment for me (or my minor child, if applicable) if necessary, and I agree to be financially responsible for any such treatment.
4. Photo/Media Release
I understand that photographs and/or video may be taken at the Event for promotional or marketing purposes. I grant permission for [Farm Name] to use my likeness (and that of any minor in my care) in such materials without compensation or further approval.
5. Minors
If I am signing on behalf of a minor, I certify that I am the parent or legal guardian of the minor or have permission from parent/legal guardian and that I have the legal authority to sign this waiver on their behalf. I agree to the terms herein for myself and the minor and assume all associated risks.
6. Governing Law
This waiver shall be governed by and interpreted in accordance with the laws of the State of Utah, and any disputes arising out of this agreement shall be brought in a court of competent jurisdiction within that state.
I understand by signing this/or checking the terms and conditions box, that I am taking all responsibility for any other persons in my party.
Use of Substances: I am fully aware that illegal substances, smoking, and alcoholic beverages are not permitted on the property or during any activities. I agree to abide by this rule. If I do not abide by this rule, I surrender my permission to be on the premises and agree to leave the property immediately.
Indemnification: I also agree to indemnify and hold harmless Gibson’s Green Acres from any loss, liability, damage, or costs, including court costs and reasonable attorneys’ fees that Gibson’s Green Acres may incur due to my participation in said activities, whether caused by Gibson’s Green Acres’ ordinary negligence or otherwise, to the fullest extent allowed by law.
Acknowledgements, Assertions, and Agreements: I warrant that a full and fair disclosure of my ability to participate in the above noted activities have been made, and further:
Health Status - I assert that I do not have any undisclosed chronic physical or mental conditions that would contra-indicate participation in agricultural or agri-tourism activities.
I possess sufficient physical fitness and skill to enable safe participation.
Emergency Care - I authorize or agree
For the administration of emergency first aid, CPR, and use an AED as may be deemed necessary:
For FARM to secure emergency medical care or transportation (i.c., EMS) as may be deemed necessary, and
To assume all costs of emergency medical care and transportation for myself and/or minor child(ren).
Rules & Safety Equipment
I agree to abide by the rules and regulations established by FARM; and
I acknowledge that the FARM is conducting all activities in good faith and may find it necessary to terminate my participation if it is determined that I am incapable of safely meeting the rigors of the activity. I accept the FARM's right to take such actions for the safety of myself, other participants, and/or the animals on the premises.
Covenant not to Sue; Mediation; Venue; and Severability Clauses: I covenant not to sue Gibson’s Green Acres for any present or future claim arising directly or indirectly from my participation at the FARM. This includes claims resulting from the inherent risks of agricultural and agri-tourism activities and the active or passive negligence of Gibson’s Green Acres.
Any action brought under this Agreement shall be brought within one (I) year of the incident.
YOU ARE GIVING UP LEGAL RIGHTS
In consideration for and as an express condition for permission to enter the s, located at Gibson's Green Acres 449 S 4700 W Ogden Utah 84404 (hereinafter called the “Facility”) and participation in any related activities on Gibson's Green Acres, Green Acres Corn Maze & Pumpkin Patch, enters into an agreement with Gibson's Green Acres, a Utah Limited Liability Company and agrees to the following:
CONSENT TO ASSUME RISKS, AWARENESS OF INHERENT RISKS, AND EXPRESS ASSUMPTION OF RISK: I understand that anyone performing any activity on or even near moving equipment or any of the Activities at the Facility can suffer bodily and other injuries. The equipment used in all the Activities are powerful and potentially dangerous devices, and their use can be unpredictable by nature, as are the actions of other individuals who are using or riding the equipment. I know that injuries of all kinds, including personal injury, death, or serious disability, as well as damage, loss or theft of personal property, can occur without warning, either on or near the equipment or any of the Activities, or anywhere in the Facility. I also understand that equipment and the equipment used in the Activities, even when properly inspected and maintained, may break or not function as expected, and always have the potential to cause injury. I also understand that jumping, climbing, laying or standing on or even being near equipment or any of the Activities or associated equipment, or being anywhere near others who are on or near equipment or any of the Activities, can expose me to numerous hazards, including collisions with any number of injurious objects, including other participants, which is an essential part of the Activities and being in the Facility. I understand all these risks and dangers that are inherent in the Activities and being in the Facility, I consent to them, and I agree to assume all of them, on behalf of myself and/or my child/ward. I also understand that these are just some of the risks, and I consent and agree to assume others that are not specifically mentioned in this document. I am NOT relying on Gibson's Green Acres to list all possible risks related to these activities in this document, now or in the future. I agree that I and/or my child/ward am voluntarily participating in the Activities offered by Gibson's Green Acres including, but not limited to, hayrides, slide, games, activities, buildings on the Facility and the premises. Further, I have explained these risks to my child/ward.
I have read and understand the foregoing CONSENT TO ASSUME RISKS, AWARENESS OF INHERENT RISKS, AND EXPRESS ASSUMPTION OF RISK.
BY SIGNING THIS DOCUMENT, I ACKNOWLEDGE THAT IF ANYONE IS HURT OR PROPERTY DAMAGED BY MY PARTICIPATION AND/OR THAT OF MY MINOR CHILD/CHILDREN IN ANY OF THE ACTIVITIES, I MAY BE FOUND BY A COURT OF LAW TO HAVE WAIVED MY RIGHT TO BRING A LAWSUIT AGAINST ANY OR ALL OF THE RELEASED PARTIES; AND
ALL OF THE INFORMATION THAT I HAVE PROVIDED IS TRUE AND ACCURATE
I ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS CONSENT TO ASSUME RISKS, AWARENESS OF INHERENT RISKS, AND EXPRESS ASSUMPTION OF RISK WAIVER AND RELEASE OF LIABILITY, CONSENT TO ARBITRATION AND INDEMNITY AGREEMENT, AND FULLY UNDERSTAND THAT IT IS A RELEASE OF ALL LIABILITY AND A WAIVER OF ANY RIGHT THAT I MAY HAVE ON BEHALF OF MYSELF AND OR MY CHILD/WARD TO BRING ALLEGATION OR ASSERT A CLAIM FOR INJURY OR LOSS OF ANY KIND AGAINST Gibson's Green Acres. SHOULD ANY CLAIM BE MADE, I UNDERSTAND AND AGREE THAT WILL BE RESPONSIBLE FOR ALL ATTORNEYS FEES AND DEFENSE COSTS INCURRED BY THE COMPANY IN CONNECTION WITH OF IN THE DEFENSE OF THAT CLAIM.

*I am at least 18 years old and I have read and agree to the terms of the above agreement.
CONSENT TO ARBITRATION: If there are any disputes regarding or arising under this agreement, I, on behalf of myself and/or my child/ward, hereby waive any right that I and/or my child/ward may have to a trial and agree that such dispute shall be brought within one year of the date of this agreement and will be determined by binding arbitration before one arbitrator to be administered by the American Arbitration Association . I further agree that the arbitration will take place solely in the state of Utah and that the substantive law of Utah shall apply.*

Corn Maze + Courtyard pass includes the Long and Short Corn Mazes, the Wagon Ride and the courtyard activities. The Haunted maze and the Bouncer are NOT included with this ticket. NO outside food or beverage is allowed. You can purchase from the concession stand.

Haunted Maze starts at 8pm on Friday and Saturday nights ONLY in October. Your timed ticket is for the time that you can get in the line. This allows you to enjoy the other activities. It includes ALL corn mazes, Wagon Ride and Courtyard Activities. Please note that our petting zoo and regular wagon rides close at dark. The Bouncer is NOT included in this ticket. NO outside food or beverage is allowed. You can purchase from the concession stand. ENTER AT YOUR OWN RISK! Participants may not use foul language, run, destroy corn or props, must wear shoes (no heels or open toed shoes), or touch the actors. You assume all risks to entering our attractions. We are not responsible for lost or stolen items. Please DO NOT attend our events if you have ANY type of health concerns or issues. DO NOT attend our attractions if you are not physically fit, have pre-existing medical conditions, have poor vision, and especially any type of heart or respiratory condition. DO NOT ATTEND OUR EVENTS if you're currently or recently experienced a fever or flu like symptoms.We use strobe lights and fog.

If you cannot come on the date for which you purchased your ticket, you may redeem it any time before our 2025 fall season is over (October 31st) for a regular weekday admission without haunt or for a Friday or Saturday evening with the Haunt.
SEASON PASS: Can be used any open day during the season, only activity excluded is the butter bouncer (always separate). Cannot be transferred to another person. Can only be used for the person originally purchased for. Ticket booth will take a picture of you for your season pass on your first visit. No refunds for any reason.
